In compliance with the information duty stipulated in Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce, users are informed that the owner of the website https://www.nomadsevents.com (the “Website”) and all its content is BE A nomads SL, a Spanish company with its registered office at Carrer de París, 45-47, Entl 3a, Eixample, 08029 Barcelona, with Tax Identification Number (C.I.F./V.A.T.) ESBB66309626, and registered in the Commercial Registry of Barcelona, Volume 44,348, Folio 153, Sheet number B-453.481.

BE A nomads is the holder of all intellectual property rights or any other type over the Website and the applications (hereinafter, “Applications”) of BE A nomads, whose access and use by users (hereinafter, “User” or “Users”) is subject to these terms of use (hereinafter, “Terms of Use”) and will be supplemented with any other legal texts that regulate any functionality, service, process, application, platform, or means necessary for the use of the Website or the Applications or connected to them.

Please read the Terms of Use carefully. Accessing the Website and/or the Applications and using the materials contained therein implies that you have read and accept, without reservation, these Terms of Use. If you do not agree with all or part of these Terms of Use, the User must refrain from using the Website and/or the Applications.

PURPOSE

The Website and the Applications contain material prepared by BE A nomads for informational purposes only. Users should be aware that such material may not be up to date. Likewise, BE A nomads reserves the right to modify, expand, or reduce the material offered through the Website and the Applications at any time, informing Users accordingly.

The material contained on the Website and/or in the Applications cannot, under any circumstances, serve as a substitute for advice. Access to this material does not intend to constitute nor implies any relationship between BE A nomads and the client, nor any other type of contractual relationship between BE A nomads and the User of the Website and/or the Applications. Therefore, the User should not act based on the information contained therein without first seeking the corresponding advice from BE A nomads. Likewise, the User should not send any confidential information to BE A nomads without having previously consulted with one of our operators and having received authorization to send such information.

In this regard, and without prejudice to the provisions of the preceding paragraphs, BE A nomads grants a non-exclusive, non-sublicensable, and non-transferable license to Users to use the Website, the Applications, and their respective functionalities, content, and other features available therein, which will be subject to the remaining terms included in these Terms of Use, as well as any other terms of use and applicable regulations.

USER COMMITMENTS

In general, the User agrees to comply with these Terms of Use, as well as to comply with any special warnings or instructions contained therein and to always act in accordance with the current law, morality, good customs, and the requirements of good faith and established public order, using due diligence, and refraining from using the Website and/or the Applications in any way that may prevent, damage, or deteriorate their normal operation, the goods or rights of BE A nomads, other Users, or, in general, any third party.

Specifically, and without this implying any restriction to the previous paragraph, the User agrees to:

Provide truthful information about the data requested in the forms provided by BE A nomads for access to certain content or services offered through the Website and/or the Applications and to keep them updated. BE A nomads reserves the right, without prejudice to other legal measures at its disposal, to withdraw, deny, or suspend access to the Website and/or the Applications in the event that the data provided is or may be false, inaccurate, or misleading. In any case, the User will be fully responsible for the data or content transmitted or communicated to BE A nomads. In this regard, the User assumes responsibility for any damages that may arise from misuse of the same.

Not to introduce, store, or disseminate through the Website and/or the Applications any program, data, virus, code, or any other electronic or physical device that is capable of causing damage to them, to any of the services, or to any of the equipment, systems, or networks of BE A nomads, any other User, or, in general, any third party.

Not to alter, copy, download, modify, decompile, disassemble, reverse engineer, license, lease, sell, or imitate the Website and/or the Applications, their contents, or their underlying software.

Not to introduce, store, or disseminate through the Applications any content that infringes industrial and/or intellectual property rights or trade secrets of third parties, or in general any content for which they do not have, in accordance with the law, the right to make available to third parties.

RESPONSIBILITIES AND WARRANTIES

BE A nomads is not responsible for any damages that may arise from interferences, omissions, interruptions, computer viruses, breakdowns, and/or disconnections in the operational functioning of the electronic system or in the Users’ computer equipment and devices, caused by reasons beyond BE A nomads’ control, that prevent or delay navigation through the Website and/or the Applications, nor for delays or blockages in use caused by deficiencies or overloads on the Internet or in other electronic systems, nor for the impossibility of providing the service or allowing access due to causes not attributable to BE A nomads, due to the User, third parties, or cases of force majeure. However, BE A nomads declares that it has adopted and will adopt, where appropriate, all necessary measures within its possibilities and the state of technology, to ensure the proper functioning of the Website and/or the Applications and to avoid the existence and transmission of viruses and other harmful components to Users.

BE A nomads reserves the right to interrupt access to the Website and/or the Applications at any time and without prior notice, whether for technical, security, control, maintenance reasons, due to power supply failures, or for any other cause. BE A nomads does not generally control the use that Users make of the Website and/or the Applications.

BE A nomads is not responsible for the use that the User makes of the content of the Website and/or the Applications that may constitute a violation of any type of national or international regulation, intellectual or industrial property rights, or any other rights of third parties.

BE A nomads is not responsible for errors or omissions that may be present in the content of the same or others that can be accessed through them. BE A nomads will also not be considered responsible for any damages arising from the use of the Website and/or the Applications, nor for any action taken based on the information provided therein.

BE A nomads does not guarantee the absence of viruses or other harmful elements that may cause damage or alterations in the computer system, electronic documents, or files of the website and/or Applications user. Consequently, BE A nomads is not liable for any damages that such elements may cause to the user or third parties.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All Intellectual and Industrial Property rights, as well as all the information contained on the Website and in the Applications (including information, texts, data, images, graphics, designs, source code, software, trademarks, navigation structures, databases, etc., and any other content appearing therein) are the exclusive property of BE A nomads.

BE A nomads grants a non-exclusive, non-sublicensable, and non-transferable license to Users to use the Website and the Applications in their current version, which will be subject to the remaining terms included in these Terms of Use, as well as any other applicable terms of use and legislation. The User is only authorized to view and obtain a temporary private copy of the contents for their exclusive personal and private use on their computer systems (software and hardware), but is not authorized to subsequently transfer them to third parties. Except as provided above, the User may not modify or reproduce, in whole or in part, this information without the express written consent of BE A nomads.

Through these Terms of Use, no intellectual or industrial property rights, such as copyrights, trademarks, designs, or other rights, are transferred over the Applications or any of their components, except for the limited use license granted to Users to use the Applications under the terms provided herein. In this regard, the reproduction, transmission, transformation, distribution, public communication, making available, extraction, reuse, exploitation, or use of any nature, by any means or procedure, of any of them is expressly prohibited, except in cases where it is legally permitted or expressly authorized in writing by BE A nomads.

Users grant BE A nomads a non-exclusive, unlimited, complete, transferable, free, and sublicensable right to use data that is not of a personal nature or data whose personal reference has been removed (anonymized data).

DATA PROTECTION

BE A nomads will protect Users’ personal data and will use it only to the extent permitted by law or when Users have given their consent. Users can find more information in the Privacy Policy.

THIRD-PARTY LINKS

These Terms of Use refer solely to the Website and the Applications and content of BE A nomads and do not apply to links, websites, and/or third-party applications accessible through them or, in general, any other service provided by third parties. BE A nomads cannot control the information, content, products, or services provided by third parties that have established links to the Website and/or the Applications, and access to them through the Website and/or the Applications does not imply that BE A nomads recommends or approves their content.

Consequently, BE A nomads assumes no responsibility that may arise from them. In case of accessing other networks or computer resources, the User agrees to comply with the provisions of the corresponding usage and privacy policies.

BE A nomads offers the User such links and information and/or services solely for the User’s convenience, being the User’s responsibility to read and accept the terms of use and privacy policies published on such linked websites or applications. Their inclusion on the Website does not imply BE A nomads’ approval of the linked website. In any case, BE A nomads states that it will proceed to the immediate removal of any link when the contents to which it redirects may contravene national or international legislation, morality, or public order.

PRIVACY POLICY

When it is necessary for the User to register or provide personal data, the collection and processing of such personal data will be carried out in accordance with the provisions of our Privacy Policy, which must be previously accepted and will always be available through the Website and/or the Applications.

APPLICABLE LAW AND JURISDICTION

The relationship between BE A nomads and the User shall be governed by the applicable Spanish legislation in force.

For the resolution of any disputes that may arise regarding access to and use of the Website and/or the Applications, the User and BE A nomads, expressly waiving any other jurisdiction that may correspond to them, agree to submit to the Courts and Tribunals of the city of Barcelona (Spain).
